Moving from Sweden to Georgia: The Tax Rules That Follow You

What Sweden does when you leave

Sweden's domestic test for ending unlimited tax liability is not a day count. It is väsentlig anknytning, essential ties, weighed across a defined list of factors: a home kept available in Sweden, a spouse or family remaining there, a business you still run or control, Swedish property, and a string of others. Any single factor can be enough on its own, and Skatteverket's own guidance is explicit that a person can be found to have essential ties years after leaving on the strength of one retained connection, such as a permanent home kept "just in case."

The five-year presumption most guides skip

If you are a Swedish citizen, or you lived in Sweden for ten years or more before leaving, Skatteverket presumes you keep väsentlig anknytning for five years after departure. The burden of proof sits on you, not the tax agency, for the entire five years: you have to affirmatively show the connection is gone, rather than Skatteverket having to show it remains. After five years the presumption lifts, but a genuinely retained tie, a home kept available being the clearest example, can still be found to preserve it indefinitely.

Two further rules matter once residency is genuinely broken. First, the tioårsregeln: Sweden keeps the right to tax capital gains on Swedish shares, and on other shares acquired while you were Swedish tax resident, for ten years after you leave, even if you sell them as a Georgian tax resident. Some of Sweden's tax treaties narrow this to a shorter window or hand the taxing right to the country of residence instead; whether the Sweden-Georgia treaty does so for your specific holdings is worth confirming before assuming either way. Second, SINK, the special flat tax on Swedish-source income paid to non-residents, currently 22.5% and falling to 20% from 2027, applies to anything Swedish-source you keep receiving once you are genuinely non-resident, such as a directorship fee or a pension.

Sweden's CFC rules, in chapter 39a of the Income Tax Act, reach a shareholder who holds 25% or more of a foreign legal entity whose income is taxed below 55% of the Swedish corporate rate, confirmed on Skatteverket's own CFC guidance. A Georgian Individual Entrepreneur is not a separate legal entity, so there is nothing for this rule to attach to. A Georgian LLC is different: it is a foreign legal entity, its retained profit is taxed at 0% until distributed, and that sits well under the Swedish threshold, so a Swedish-controlled Georgian LLC is a real CFC candidate in a way an IE is not.

Georgia and Sweden have had a double taxation treaty in force since 26 July 2014, confirmed on Georgia's Ministry of Finance treaty list, which gives a tie-breaker to fall back on once residency is actually disputed. Sweden relies on the EU's list of non-cooperative jurisdictions rather than a separate national blacklist, and Georgia does not appear on it, so there is no Swedish blacklist issue standing in the way here.

  1. List every Swedish tie before you book a flight. A home kept available, a spouse or minor children remaining in Sweden, a business you still control, Swedish directorships, and Swedish property all count. Anything left standing on this list is a live risk to väsentlig anknytning.
  2. Close or transfer the home properly. Selling it, or letting it go under a lease with no reserved right for you to use it, is what actually closes this tie. A home held "empty just in case" is the single most common way this fails.
  3. Move your family and your economic centre together, where possible. A spouse or dependent children remaining in Sweden is one of the heaviest weighted factors, and it is hard to outweigh with anything else on the list.
  4. File your Swedish departure correctly and keep the documentation, since you will likely need to affirmatively demonstrate the absence of essential ties if Skatteverket asks, not the other way round.
  5. Check your specific shareholdings against the tioårsregeln before you assume a future sale is Georgia's problem rather than Sweden's.
  6. Register a Georgian Individual Entrepreneur and apply for Small Business Status, either in person or under power of attorney through remote company registration.
  7. Choose an IE over an LLC if Swedish CFC exposure is a live concern, since an IE generally sits outside chapter 39a while a Georgian LLC does not.
